Useful Decisions

The decisions made in relation to planning appeals affecting allotment sites or in response to applications for the disposal of statutory allotment sites are important in terms of the precedent they set and the influence they can therefore have on future decisions. Understanding such decisions can give useful insight into the way any particular case may be treated.

 

Here are a couple of decisions that our Association cited in its evidence to the Section 8 Public Inquiry held in April 2005:

Allotment Site, Seymour St, Chelmsford, Essex

Appeal Decision hearing held on 27th November 2003 by Roger Clews BA MSc CertEd DipTP MRTPI

The Appeal was in respect of a proposed development for which planning permission had been refused.  The development was to erect 15 two-bedroom apartments with associated parking that would have resulted in the loss of unoccupied allotments for which there was a demonstrable demand.  The Appeal was dismissed.

 

Disposal of Allotment Land, Plot 1, at Blacksmiths Lane, Prestbury

In a letter to Prestbury Parish Council (dated 16th August 2004), Government Offices for the South West refused consent for the disposal of Plot 1 on the grounds that the necessary disposal criteria could not be satisfied.
